Supplemental H-2B visas released, with restrictions Email

Last week, the US Department of Labor (DOL) and Department of Homeland Security (DHS) issued a joint rule. This temporary final rule authorizes the release of 22,000 supplemental H-2B visas for the current fiscal year (2021). It was posted to the Federal Register on May 25.

The rule has some restrictions. All businesses must demonstrate that they “are likely to suffer irreparable harm without these additional workers.” 16,000 of the visas are reserved for returning workers who had previously entered the US on H-2B visas in FY 2018, 2019, or 2020. The remaining 6,000 visas are reserved for workers from Honduras, Guatemala, or El Salvador. Those 6,000 visas are exempt from the returning worker requirement. If all of the visa requests for workers from Honduras, Guatemala, or El Salvador are not used by July 8, 2021, remaining visas can be used for returning workers of any nationality.
