DOL issues more clarification on FLSA compliance Email

FLSA complianceThe U.S. Department of Labor (DOL) issued two new opinion letters this week that address compliance issues related to the Fair Labor Standards Act (FLSA). The letters are responses to specific questions asked of DOL and are official clarifications of how the law applies in the circumstances presented in the letter.

  • FLSA2020-1: Addressing calculating overtime pay for a non-discretionary lump sum bonus paid at the end of a multi-week training period.
  • FLSA2020-2: Addressing whether per-project payments satisfy the salary basis test for exemption.

Employers and workers alike are encouraged to submit requests for opinion letters in order to clarify the correct way to comply with Wage and Hour Division laws. Requests can be submitted online.
