The decision to continue services is an individual choice that landscape companies must make based on the definition of “essential business” or “critical services” as it applies to each project. Each company must use their best judgment and determine its workload based these definitions of essential services. It’s very important that company owners and leaders talk with employees about why they are an essential service and provide them guidance in this matter.

The first of three relief packages approved to date by Congress was HR 6201, Families First Coronavirus Response Act (FFCRA). It was passed on March 18 and took effect April 1, 2020. On April 3, the US Department of Labor (DOL) announced additional guidance regarding paid sick leave and expanded family and medical leave from the act.

The US Senate’s Coronavirus Aid, Relief, and Economic Security Act or CARES Act (S.3548) provides emergency loans, tax credits, grants and more to address the economic impact of the pandemic. In addition to the law itself, government agencies have released guidance and instructions to help citizens take advantage of the aid provided.

Landscape companies are adapting to the COVID-19 pandemic in different ways. Some are able to continue working under the “essential services” definition in Colorado. Others have opted to delay operations they deem non-essential in order to “flatten the curve” and keep their team and the public safe. All companies must alter their operations in some way and find new ways to be successful.

COVID-19 and the American Workplace
On April 1, 2020, the U.S. Department of Labor announced new action regarding how American workers and employers will benefit from the protections and relief offered by the Emergency Paid Sick Leave Act and Emergency Family and Medical Leave Expansion Act, both part of the Families First Coronavirus Response Act (FFCRA). The Department’s Wage and Hour Division (WHD) posted a temporary rule issuing regulations pursuant to this new law, effective April 1, 2020.
