Colorado Employment Verification Law repealed Email

Form I-9Effective today (August 10, 2016), employers do not need to complete the additional employment verification for the State of Colorado. In June 2016, Governor Hickenlooper signed a repeal of this requirement. The verification form was determined redundant and unnecessary in light of the federal Form I-9 Employment Eligibility Verification.

Going forward, employers need only comply with the federal I-9 requirements and may cease using the Colorado verification form. It is helpful to note that the current Form I-9 has an expiration date of March 31, 2016. An update form has not yet been issued. IRS guidance directs employers to continue using the last expired version until that new form is made available.

In 2007, the Colorado Employment Verification Law went into effect for all new hires in the state. This law required documentation by Colorado employers to verify that new employees are eligible for employment in the United States. This verification was required within 20 days of hire and was in addition to the federal Form I-9. Employers were also required to keep records of the verification.
